The European Union (EU) has made a significant breakthrough in the regulation of artificial intelligence (AI). AI systems that are considered low-risk will be subject to minimal transparency obligations, such as disclosing that their content is AI-generated. On the other hand, high-risk AIs will be subject to a range of requirements and obligations to ensure accountability and mitigate potential harms.
One of the key provisions of the AI Act is the mandate for human oversight of high-risk AI systems. Developers must implement robust risk management frameworks that systematically assess potential harms, vulnerabilities, and unintended consequences of their systems. The regulation goes a step further by banning the use of certain AI systems deemed to have unacceptable risks. For example, facial recognition AI in public areas will be prohibited, with exceptions for use by law enforcement. The legislation also targets AI systems that manipulate human behavior, use social scoring, or exploit vulnerable groups. Emotional recognition systems in schools and offices, as well as the scraping of images from surveillance footage and the internet, will also be banned.
In order to enforce compliance, the AI Act imposes penalties on companies that violate the regulations. Companies found to be using banned AI applications will face fines of up to 7% of their global revenue. Violations of obligations and requirements will result in fines of up to 3% of the company’s global revenue. This financial consequence aims to ensure that companies take the regulation seriously and prioritize ethical and responsible AI practices.
However, the EU recognizes the importance of fostering innovation in the AI sector. Therefore, the AI Act allows for the testing of innovative AI systems in real-world conditions with appropriate safeguards. This approach aims to strike a balance between regulation and innovation, propelling the EU to the forefront of the global AI race.
A Global Standard
Although the EU is leading the way in AI regulation, other countries such as the U.S., U.K., and Japan are also working on their own AI legislation. The EU’s AI Act has the potential to become a global standard for countries seeking to regulate AI. Its comprehensive and risk-based approach, emphasis on human oversight and transparency, responsible data practices, and proactive risk management set a benchmark for AI regulations, ensuring the development and adoption of AI that is safe, trustworthy, and respects fundamental rights.
